Agreement to Terms

By accessing or using AppFeedBackScratch ("the Service," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

IMPORTANT: AppFeedBackScratch is in beta. Features may change, and the service may contain bugs or errors.

Eligibility

To use AppFeedBackScratch, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into this agreement
  • Not be barred from using the Service under applicable law

Account Registration

Creating an Account

  • You must authenticate using Google OAuth
  • You must provide accurate, current, and complete profile information
  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized access

Account Security

  • Do not share your account credentials
  • Log out after each session on shared devices

Beta Service

Beta Status

AppFeedBackScratch is currently in beta:

  • Features may change, be added, or removed without notice
  • The Service may be unavailable at times for updates or maintenance
  • We may terminate the beta program at any time
  • No guarantee of service availability

No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE MAKE NO WARRANTIES ABOUT:

  • Accuracy or quality of feedback received
  • Availability or reliability of the Service
  • Fitness for any particular purpose

User Content

Your Submissions

When you submit apps or provide feedback through the Service:

  • You retain ownership of your content
  • You grant us a license to display, distribute, and process your content to operate the Service
  • You represent that you have the right to share any content you submit
  • This license ends when you delete your content or account

Feedback and Reviews

  • Feedback you provide is visible to the app developer and other users
  • You agree to provide honest, constructive feedback
  • You may not use feedback to harass, abuse, or defame other users
  • We reserve the right to remove feedback that violates these terms

App Submissions

  • You represent that you have the right to submit the app for review
  • You are responsible for the accuracy of app descriptions and URLs
  • We are not responsible for the content or functionality of submitted apps

Acceptable Use

You Agree NOT To:

  • Use the Service for any illegal purpose
  • Violate any laws or regulations
  • Submit spam, fake reviews, or misleading information
  • Manipulate the feedback system (e.g., exchanging fake positive reviews)
  • Infringe on intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Impersonate others or provide false information
  • Share your account with others
  • Use automated tools to access the Service (scraping, bots, etc.)
  • Reverse engineer or decompile the Service
  • Harass, threaten, or abuse other users

Intellectual Property

Our Property

  • AppFeedBackScratch and all content, features, and functionality are owned by us
  • Our name, logo, trademarks, and branding are our property
  • You may not use our intellectual property without written permission

Your Data

  • You retain ownership of your content (app submissions, feedback, profile information)
  • You grant us a license to use your content to provide the Service
  • We may use anonymized, aggregated data for analytics and improvements
  • This license ends when you delete your account

AI Processing

  • We use third-party AI services to consolidate and summarize feedback
  • AI-generated summaries are provided for convenience and may not be perfectly accurate
  • You should read individual feedback in addition to AI summaries
  • We are not responsible for inaccuracies in AI-generated content

Third-Party Services

AI Services

  • Feedback consolidation is provided by third-party AI services
  • The AI provider's terms apply to their services
  • We are not responsible for AI accuracy or performance

Other Services

  • We may integrate with other third-party services
  • Third-party terms and policies apply
  • We are not responsible for third-party services

Privacy

Your use of the Service is also governed by our Privacy Policy.

Fees and Payment

AppFeedBackScratch is currently free to use during the beta period. We reserve the right to introduce paid features or subscriptions in the future with advance notice.

Termination

By You

  • You may delete your account at any time
  • Your data will be deleted within 30 days

By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • Your account is inactive for an extended period
  • We terminate the beta program
  • Required by law
  • We cease operations

Effect of Termination

  • Your access to the Service ends immediately
  • Your data will be deleted per our retention policy
  • Provisions that should survive (warranties, limitations of liability) continue

Disclaimers

Feedback Quality

  • WE DO NOT GUARANTEE THE QUALITY OR USEFULNESS OF FEEDBACK
  • Feedback represents individual opinions and may not be accurate
  • Do not make critical business decisions based solely on feedback received through the Service

No Professional Advice

  • The Service does not provide professional advice of any kind
  • Feedback from other users is their personal opinion, not expert consultation

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • WE ARE NOT LIABLE FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE
  • WE ARE NOT LIABLE FOR DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE
  • OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $0 IF THE SERVICE IS FREE)

This limitation applies even if we have been advised of the possibility of such damages.

Specific Disclaimers

We are not liable for:

  • Quality or accuracy of feedback received
  • Decisions made based on feedback
  • Content of submitted apps
  • Actions of other users
  • Data breaches by third-party service providers
  • Loss or corruption of your data
  • Downtime or service interruptions

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of third-party rights
  • Content you submit to the Service

Dispute Resolution

Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles.

Arbitration Agreement

PLEASE READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS

Any dispute arising from these Terms or the Service will be resolved through binding arbitration, not in court, except:

  • Small claims court disputes (under $10,000)
  • Intellectual property disputes
  • Injunctive relief requests

You waive your right to a jury trial and to participate in class actions.

Arbitration will be conducted by the American Arbitration Association (AAA) under their Consumer Arbitration Rules.

Exceptions to Arbitration

You may opt out of arbitration by sending written notice within 30 days of first using the Service to: travis@readyrickshaw.com.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Updating the "Last Updated" date
  • Displaying a notice in the application

Continued use after changes constitutes acceptance. If you don't agree to changes, you must stop using the Service.

General Provisions

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and us.

Severability

If any provision is found unenforceable, the rest of the Terms remain in effect.

No Waiver

Our failure to enforce any right or provision is not a waiver of that right.

Assignment

You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, pandemics, infrastructure failures, etc.).

Survival

Provisions that should survive termination (warranties, limitations of liability, indemnification) continue after termination.
